General Data Protection Regulation (GDPR) and Data Protection Consulting Services
The Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, on the protection of natural persons regarding the processing of personal data, the free movement of such data, and the repeal of Directive 95/46/EC ("General Data Protection Regulation" or GDPR), fundamentally changes the data protection framework in Europe. Starting May 25, 2018, a new data protection regime also came into effect in Austria, bringing significant changes to the daily operations of businesses.
Key Changes Under the GDPR
- The obligation to submit DVR notifications to the Austrian Data Protection Authority is no longer required.
- Data controllers are now responsible for managing their data processing activities in a dedicated internal register under the conditions specified in Article 30 of the GDPR.
- In certain situations, data protection impact assessments (DPIAs) must be conducted per Article 35 of the GDPR to evaluate the lawfulness of specific data processing activities.
